Background

When you interact with us, we collect data.

Sometimes you give it to us. For example, when you order a product, you tell us where to deliver it. Sometimes we collect it automatically. For example, through our use of cookies on our website, which we explain in more detail below.

We have written our Privacy & Cookies Policy to set out how we collect, hold, use and disclose that data. We also want you to know who to contact if you want to give us feedback on these issues.

Our policy applies whether you're interacting with us online, in stores or through our customer service team.

Who we are

We are the Just Group, including all of its subsidiaries (we, our, or us). We own and operate five apparel brands in Australia and New Zealand. The brands are Dotti, Jacqui E, Jay Jays, Just Jeans, and Portmans (Just Group brands). Myer Holdings Limited (Myer) owns the Just Group.

The Peter Alexander and Smiggle brands, owned by Premier Retail Holdings Limited, are also operating on the Just Group website for a transitional period after the acquisition of the Just Group by Myer. You can read more about Myer's acquisition of the Just Group in the About Us section of this website.

This policy applies to your dealings with the Just Group website for all brands, and in-store with the Just Group brands, in Australia and New Zealand.

Smiggle and Peter Alexander have their own privacy policy for in-store purchases at those brands' Australian and New Zealand retail stores, which is available here.

If you're buying Just Group brands from our Australian website or visiting our Australian Just Group brand stores, or if you are buying Peter Alexander or Smiggle brands from the Just Group website, then you are contracting with Just Group Limited ABN 97 096 911 140 (Just Group) whose registered office is at 457 St Kilda Road, Melbourne, Victoria 3004.

If you're buying Just Group brands from our New Zealand website or visiting our Just Group brand stores in New Zealand, or if you are buying Peter Alexander or Smiggle brands from the Just Group website, then you are contracting with Kimbyr Investments Limited (NZBN 9429040001807) (Kimbyr), whose registered address is 38 Sir Woolf Fisher Drive, Highbrook, Auckland, 2013, New Zealand.

Just Group has entered into a services contract with Premier Retail Services Pty Ltd for a transitional period under which Premier Retail Services Pty Ltd has agreed to provide Just Group with services including in relation to the storage, handling and processing of personal information on the Just Group website. This means that Premier Retail Services Pty Ltd will, in addition to the Just Group, have access to information that is collected from your use of our website during the transitional period.

Respecting Your Privacy – Our Commitment To You

We know how important your personal information is to you. We are committed to safeguarding that information.

We will follow all the privacy and data protection laws that apply. This policy doesn't limit any of those laws.

Your Choices and Rights

You're in control. You can:

  • tell us to stop sending you emails;
  • turn off cookies;
  • ask us to access the personal information we hold about you and to tell you how it's used, or to correct things that aren't accurate;
  • request that we transfer your information to you; and
  • if it's no longer necessary for us to hold that data, request that we delete your personal information or stop processing it and collecting it.

Sometimes your rights are subject to exceptions permitted by law, for example, where an access request might prejudice law enforcement activities. We'll give you reasons if we can't comply with a request. Please send any requests to our Privacy & Data Protection Officer (details below).

If you have any concerns about any aspect of our privacy practices, please contact us on the details provided at the end of this policy. We may ask you to put your concerns in writing and provide details about it. We will inquire into your complaint and respond to you in writing within 30 days. If you are not satisfied with our response or alternatively to contacting us, you can also report it to the relevant privacy or data protection supervisory authority in your country of residence or work, or the place of any alleged breach. In Australia, that's the Office of the Australian Information Commissioner (www.oaic.gov.au). In New Zealand, it's the Office of the Privacy Commissioner (www.privacy.org.nz).

How We Collect Personal Information, What Types of Personal Information Do We Collect and Why?

The personal information we collect about you depends on your interactions and transactions with us. The list below is not necessarily complete. Sometimes we may need to collect additional information for one or more of the purposes set out in this policy.

If you don't want to give us your personal information or you want to remain anonymous, that's okay too. But this may restrict our ability to provide you with our services or access to certain features on our websites. For example, you can checkout as a guest without creating an account or signing up to our database, but we still collect certain personal details from you to fulfil & deliver your order.

If we receive personal information that we did not ask for or try obtain from you, and we could not have otherwise collected that personal information from you in accordance with this privacy policy and the applicable privacy laws, then we will destroy the information or ensure that the information is de – identified as soon as practicable, if it is lawful and reasonable to do so.

Contact Details: For example, your name, address, phone number and email address. We use this to update you on your order & fulfil it, send you emails about our products, for fraud prevention and detection, to show you our adverts as your browse the web or social media, and to find out more about what you and other customers like.

Transaction Information: We use this to take payments, give refunds and for fraud prevention and detection (don't worry, we don't keep your credit card details).

Order History: We use this to perform our contract with you so you can purchase products from us, so that our customer service team members can provide you with support and assist with returns and refunds, and so that we can find out what you and other customers like to make sure we are providing you with the best possible shopping experience. It also helps us anticipate demand and to keep up with it.

Competition Entry Info: We use this so you can participate in promotions and competitions, including contacting all our lucky prize winners.

How You Use Our Site: We use this to give you a better shopping experience overall.

Your Communication and Marketing Preferences: We use this information to make sure we are only sending marketing communications that we are legally able to.

Your Location: We use this to offer you a better shopping experience, depending on where you live.

Your Interests, Preferences, Feedback and Survey Responses: We use this to give you a better shopping experience, for our internal market research purposes and to deliver targeted advertising to you based on those interests.

CCTV and Your Image: In some of our higher risk stores, we use CCTV camera for crime and theft prevention. If you visit these stores, your image may be captured. You'll know which stores this applies to as it will be clearly signed. The cameras will be clearly visible and will only be placed in public areas.

Month of Birth: We use this for our birthday club VIPs, so we can send birthday month offers.

Member Info as part of a Loyalty Program: If you join our loyalty program, Just Shop Rewards™, or are a member of the Smiggle VIP program, we may collect additional types of information from you to help administer the relevant loyalty program, and provide rewards granted to you as a member of the relevant loyalty program. Our Purpose for Collecting, Using, Disclosing or Otherwise Handling Your Personal Information

Privacy and data protection laws require us to have a lawful purpose for collecting and using your data and/or personal information. This is sometimes described as a "legal basis".

Here are the purposes for which we collect, use, disclose or otherwise handle your data:

Consent: We can collect and process your information with your consent and for a specific purpose. For example, when you opt in to receive marketing communications from us. You might do this directly from our website, or you might sign-up in store. You can always change your mind. All our emails have an unsubscribe option, or you can also contact us to stop receiving them (such as for text messages).

Contract: In certain circumstances, we need your personal information to comply with a contract we have with you (or if we've asked you to take a particular step before entering into that contract). For example, ordering from us is a contract you have with us.

Legitimate Interest: This is where processing your data is needed for our legitimate interests or those of a third party, provided those interests aren't outweighed by yours. Our legitimate interests include improving our service, determining whether marketing campaigns are effective and enabling us to enhance our business. For example, we sometimes combine the purchase history of our customers to identify trends and make sure we can keep up with demand.

Legal Compliance: Sometimes we're required by law to collect and process your information. For example, where we pass on details of people involved in fraud or criminal activity to the police (such as anything captured on CCTV); or where we might be required to pass on information about a product recall.

Sharing Your Personal Information

We and Premier Retail use carefully selected third parties in certain parts of our business. The relevant organisations to whom we may disclose your personal information or data include those:

  • who deliver customer relationship management;
  • who are involved in the warehousing and delivery of online orders;
  • involved in the payment systems, including financial institutions, merchants and payment organisations (including gift cards);
  • involved in research and/or analysis including data analytics and statistical activities (including for direct marketing);
  • involved in providing, managing or administering your product or service, such as third party suppliers, other Just Group brands, loyalty and affiliate program partners, printers, posting services and call centres;
  • involved in maintaining, reviewing and developing our business systems, applications, procedures and infrastructure, including testing or upgrading our computer systems, storage and hosting;
  • business advisors, including lawyers, accountants, insurance, recruitment advisors and agencies, auditors or other professional service providers to the extent reasonably required;
  • regulatory, investigative or government bodies to comply with applicable laws or respond to valid legal process such as a search warrant, a court order or a subpoena and fraud management; and
  • which are Just Group brands (being Dotti, Jacqui E, Jay Jays, Just Jeans and Portmans) and the Myer group of companies (Myer Holdings Limited being our parent company), Premier Retail-owned brands such as Smiggle and Peter Alexander, operating transitionally on our website, and approved third parties, who wish to tell you about their products or services, promotions or other opportunities, or where you have opted-in to receive communications from these parties.

International Transfers

We may from time to time transfer or disclose your data and/or personal information to our overseas affiliates or our third party service providers, including those in Japan, Singapore, India, Sri Lanka, Vietnam, Hong Kong, the Philippines, the United States of America, and in respect of Peter Alexander and Smiggle brands only, the United Kingdom.

Where we transfer information overseas, we will take such steps as are reasonable in the circumstances to ensure that the overseas recipient does not breach the applicable Australian Privacy Principles.

In respect of Peter Alexander and Smiggle brands, Premier Retail has stores all over the world. Those international stores may transfer your information back to Premier Retail, whose global head office is in Australia.

We also use some third parties to administer part of our service delivery, so some of the uses and disclosures may occur outside of your country of residence. This means that sometimes we'll need to transfer your personal information between countries (as listed above) and in particular to and from Australia (where our central database is operated).

By submitting your personal data, you agree to this transfer, storage and processing. Despite this, be assured that we will take reasonable steps to protect your data and prevent any third parties outside of your country of residence using your personal data in any way that's not set out in this policy.

Security & Data Retention

Your information is stored securely whether in an electronic or physical form. We take all reasonable steps to protect all personal information from misuse, loss, interference, unauthorised access, modification or disclosure. If you transact with us online, make sure you keep your account details secure and contact us if you think your account has been accessed or your privacy rights have been breached.

We'll hold on to your personal information only for as long as is necessary for the purpose(s) we collected it or where we have a legitimate interest to continue doing so. Sometimes we are required by legal or regulatory requirements to keep hold of some of your information even after you have closed your account with us. This may be to resolve disputes, prevent fraud, tell you about a product safety issue or to apply our terms and conditions.

Children

We acknowledge and support the importance of children's privacy and safety. We do not knowingly collect personal information from children under 16.

If you become aware that a child under 16 has provided us with personal data without parental consent, please contact us through our Privacy & Data Protection Officer whose details are set below. If we become aware that a child under 16 has provided us with personal information without parental consent, we will attempt to delete that information as soon as possible.

Updating this Privacy Policy

Sometimes we will need to update this policy, for example to explain a new process or to comply with new laws. The last time we changed the policy was on 26 January 2025. If we update the policy, we'll put a new one on our website.
